Draft for review, not yet in effect

This document describes how BizSkipper works today. It has not been reviewed by a lawyer and takes effect only when a version with an effective date is published. 6 details are marked “To be confirmed”. Points marked “For legal review” need professional confirmation.

1. About these terms

These terms are an agreement between you and [To be confirmed: registered legal name of the business] (“we”, “us”), which provides BizSkipper. If you use BizSkipper for a business, you confirm that you may accept these terms for it. The Privacy Policy and the Refund and Cancellation Policy form part of these terms.

For legal review: Decide how acceptance is recorded. Sign-up links to these terms but does not yet ask people to accept them or record which version they accepted.

2. Accounts and workspaces

  • You need an account with a confirmed email address. Give accurate information and keep it up to date.
  • Where it is offered, you can also sign in with your Google account. We never receive your Google password, and Google’s own terms apply to your Google account.
  • You can add a mobile number to your account and confirm it with a one-time code sent by text message, where this is offered. A number can be confirmed on only one account at a time.
  • Keep your password private and do not share your account. You are responsible for what happens in your account; tell us at info@bizskipper.com if you think someone else has used it.
  • Some sensitive changes, such as changing your email address or linking a Google account, ask you to confirm your password or sign in again first.
  • A workspace belongs to one business. Its owners decide who to invite and which role each person has (owner, admin or member); roles decide who can connect accounts, publish, change the AI spending cap and pay.
  • Owners are responsible for the people they invite and for removing access that is no longer needed.

For legal review: Confirm the minimum age and capacity to contract, and whether consumers (not only businesses) may use the service.

3. What BizSkipper provides

BizSkipper helps a business understand and improve its marketing: a business profile, website checks and search analysis, AI-drafted marketing plans, recommendations from connected advertising data, social media publishing and reports from the accounts you connect.

The service is in early access and changes as it is built. Some features work only once you connect an account, once a provider is set up for the service, or where payments are switched on; each page says what it needs.

4. AI-generated content and recommendations

  • Marketing plans, explanations and other text BizSkipper drafts with AI are produced from the information you and your connected accounts provide. They can be wrong, incomplete or out of date.
  • Each recommendation shows where its information came from and, where available, how confident it is. Review it before you act on it; the decisions you make, and their results, are yours.
  • Before you publish AI-drafted content or use it in advertising, check that it is accurate and lawful, that you have the right to use it, and that it follows the rules of the platform where it appears. Similar content may be drafted for other customers.
  • BizSkipper does not promise any result, such as a search ranking, traffic, leads, sales or a return on advertising.
  • Nothing in the service is legal, tax or financial advice.
  • AI runs only while it is switched on and within the monthly AI spending cap your workspace sets.

5. Website checks, search analysis and rank measurement

  • Only enter websites that belong to your business or that you are allowed to have checked. Competitor websites are read only through their public pages, following their robots.txt rules.
  • A check reads a limited number of public pages as a search engine would. Content that appears only after scripts run may be missed, so a check can be incomplete.
  • Search figures come from Google Search Console and are Google’s; local rank measurements come from a third-party provider and are a snapshot that varies with time, place and device.
  • Each rank measurement makes paid requests to that provider and asks you to confirm first.

6. Third-party platforms and accounts you connect

  • Connect only accounts you control or are authorised to manage. You remain responsible for them and for following each platform’s terms and policies (for example Google’s, Meta’s, LinkedIn’s and OpenAI’s).
  • BizSkipper publishes, changes a Google listing, changes an ad campaign or spends money on a platform only after a person in your workspace with permission confirms it.
  • Each platform is run by its own operator under its own terms and privacy policy. Platforms can change, limit or withdraw access at any time, and some need their approval before a feature works. When that happens, the feature may stop working, and the page says so.
  • You can disconnect an account at any time.

7. Acceptable use

You must not use BizSkipper to:

  • access an account, workspace or connected platform you are not authorised to use;
  • publish, change or spend anything on behalf of a business or person without their authority;
  • publish content that is unlawful, misleading, infringing or that breaks a platform’s rules;
  • add personal information about other people without the right to do so;
  • create accounts in bulk or with automated tools, or get around a security check;
  • test, probe or overload the service, get around its limits or security, or read it with automated tools;
  • copy, resell or reverse engineer the service, except where the law allows.

8. Prices, billing and payments

  • Some actions, such as generating a marketing plan, are paid per use where payments are switched on. Each payment buys one action.
  • The price comes from our price list and is shown, with its tax, before you pay. Only workspace owners can pay.
  • Payments are processed by Razorpay. We do not receive or store card, UPI or bank details.
  • A paid action starts once Razorpay confirms the payment. Refunds and cancellations follow the Refund and Cancellation Policy.
  • Every paid order has a receipt on the Billing page. It is a payment receipt, not a tax invoice.
  • Advertising spend is never paid through BizSkipper: you pay advertising platforms directly. The AI spending cap is a limit you set, not money you pay us.

For legal review: Confirm the tax treatment (GST, and export of services for customers outside India, including whether a Letter of Undertaking applies), whether tax invoices must be issued, and how foreign-currency payments, conversion and refunds are described for international customers.

9. Subscriptions and Marketing Tokens

BizSkipper does not currently sell subscriptions, prepaid balances or Marketing Tokens (units that would measure the use of AI and data features). Nothing you buy today renews automatically.

If we introduce them, the price, billing period, what each plan includes, how tokens are used up and when they expire will be shown before you buy, and these terms will be updated first, as described under “Changes to these terms”.

For legal review: Before subscriptions or Marketing Tokens go on sale, confirm: billing cycle, renewal and cancellation; refunds for subscriptions and unused tokens; the token allowance per plan and how each feature uses tokens; whether unused tokens roll over or expire; whether tokens have any cash value or can be transferred; what happens to tokens when a workspace or account closes; GST treatment; and consent rules for recurring card and UPI payments (for example the RBI e-mandate rules).

10. Your information and content

You keep ownership of the information and content you put into BizSkipper. You allow us to store, process and send it only as needed to provide the service to you, as described in the Privacy Policy. You are responsible for its accuracy and for having the right to use it, including personal information about other people.

For legal review: Confirm the scope of the licence to customer content, and who owns AI-generated plans and other AI-drafted content.

11. Our intellectual property

BizSkipper, its software, design and name belong to [To be confirmed: registered legal name of the business]. These terms give you the right to use the service, not ownership of it.

12. Availability and changes to the service

We work to keep BizSkipper available, but it can be interrupted for maintenance, by faults, or when a provider or connected platform is unavailable or delays its data. We do not promise any level of availability. When information is missing or late, the page shows it as unavailable instead of estimating it.

For legal review: Decide whether to offer any service level and how notice of significant feature changes or discontinuation is given.

13. Suspension, termination and closing an account

  • You can stop using BizSkipper at any time and disconnect your accounts. Deleting an account or a workspace is not available in the app yet; ask info@bizskipper.com and we will handle it by email.
  • We may suspend or close access if these terms are broken, to protect the service, its users or a connected platform, or where the law requires it. Where we reasonably can, we will tell you why first.
  • When access ends, information is kept or deleted as described in the Privacy Policy, and paid orders are handled under the Refund and Cancellation Policy.

For legal review: Confirm notice periods, the right to export data before closure, and treatment of unused paid orders on termination.

14. Disclaimers and limitation of liability

Except where the law does not allow it, BizSkipper is provided as it is and as available, and our total liability to you is limited to [To be confirmed: limit of liability]. We are not responsible for losses caused by platforms or providers outside our control, by decisions you make from recommendations or AI-drafted content, or by actions you confirm. Nothing in these terms limits liability that cannot be limited by law.

For legal review: This clause is a proposal only. Confirm enforceable wording, the cap and exclusions under Indian law (including the Consumer Protection Act 2019) and for international customers, and whether an indemnity from customers should be added.

15. Governing law and disputes

If you have a complaint, contact info@bizskipper.com first so we can try to resolve it. These terms are governed by [To be confirmed: governing law], and disputes are decided by [To be confirmed: courts or arbitration seat for disputes]. Any rights you have under the consumer protection law of your country are not affected.

For legal review: Choose the governing law and courts or arbitration seat, considering customers outside India (for example in the UAE), and confirm grievance-handling duties under India’s Consumer Protection (E-Commerce) Rules 2020 if they apply.

16. Changes to these terms

Each version of these terms has a version number and an effective date. We will give [To be confirmed: notice period for material changes] notice of a material change, by email or in the app, before it takes effect.
